1. Introduction
Welcome to AllClearGear. By accessing our website, registering an account, or using our marketplace services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. Account Registration
To access certain features of the marketplace, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for any activities or actions under your account. AllClearGear cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
3. Prohibited Sales and Activities
As a user of the AllClearGear marketplace, you agree not to use the service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.
CRITICAL RESTRICTION: International sales are strictly prohibited.
All shipping, billing, and user registration must be within the United States. Any attempt to bypass these geographical restrictions will result in immediate account termination and potential forfeiture of funds. Exporting restricted tactical gear or ITAR-controlled items outside the United States is a federal offense.
Additionally, you may not list or sell items that are:
- Illegal, counterfeit, or stolen.
- Active military property not authorized for civilian resale.
- Explosives, destructive devices, or un-demilitarized ordnance.
- Items restricted by ITAR (International Traffic in Arms Regulations) if sold to non-US persons.
4. Buying and Selling
For Sellers: You must have the legal right to sell the items you list. Listings must accurately describe the item, including its condition, defects, and NSN (National Stock Number) if applicable. Sellers are responsible for fulfilling orders promptly and shipping items to the address provided.
For Buyers: When purchasing an item, you agree to pay the listed price, including any shipping fees and applicable taxes. AllClearGear facilitates the transaction but is not the seller of the items.
5. Payments and Fees
AllClearGear uses Stripe as a third-party payment processor. By making or receiving payments on the platform, you agree to Stripe's Services Agreement.
Sellers may be charged a platform fee for successful transactions, which is automatically deducted from the payout. Detailed fee structures are provided during the seller onboarding process.
6. Disputes and Refunds
Buyers and sellers are encouraged to communicate and resolve issues directly. If a resolution cannot be reached, a dispute may be opened within the platform. AllClearGear reserves the right to make the final decision on all disputes, which may result in a refund, partial refund, or denial of the claim.
7. Limitation of Liability
AllClearGear provides the marketplace "as is" without any express or implied warranties. We do not guarantee the quality, safety, or legality of items advertised, the truth or accuracy of users' content or listings, the ability of sellers to sell items, or the ability of buyers to pay for items.
In no event shall AllClearGear be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues.
8. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of any significant changes. Your continued use of the platform after such changes constitutes acceptance of the new Terms.
